Terms of Service

These terms govern your use of toddssportinggoods.com and any order placed with Todd's Sporting Goods ("Todd's," "we," "us"). By requesting a quote or placing an order, you agree to them.

Quotes and Pricing

Quotes are valid for 30 days unless stated otherwise, and are based on the quantities, garments, decoration method, and imprint sizes specified at the time of quoting. Changes to quantity, garment, ink or thread colors, imprint locations, or decoration method may change the price. Supplier price increases, garment discontinuations, and freight surcharges outside our control may require a revised quote before production begins.

Artwork and Approval

You are responsible for reviewing and approving all proofs before production. Once you approve a proof, that approval is final — Todd's is not responsible for errors in spelling, names, numbers, sizes, colors, or placement that appeared on an approved proof.

Artwork you supply must be in a usable format. If your files require recreation, vectorizing, or digitizing for embroidery, art charges may apply and will be quoted in advance. Digitized embroidery files and separated screen art created by Todd's remain our property, though we will maintain them for your reorders.

Customer-Supplied Artwork and Intellectual Property

By submitting artwork, logos, names, or marks to us, you represent that you own them or have written permission to use and reproduce them. This includes school, league, team, corporate, collegiate, and professional marks. You agree to indemnify and hold Todd's harmless from any claim arising from the reproduction of artwork you supplied. We reserve the right to decline any order we believe infringes a third party's rights.

Custom Products Are Not Returnable

Decorated and custom-manufactured goods are made to order and cannot be returned, exchanged, or refunded except for a defect in our workmanship or a decoration error that does not match your approved proof. Claims must be made within 7 days of delivery, with the goods unworn, unwashed, and unaltered. Approved-proof errors, customer-supplied sizing errors, and change-of-mind are not returnable.

Color, Garment, and Product Variation

Screen, monitor, and printed proof colors are representations only and will not match final production exactly. Ink, thread, and garment dye lots vary between production runs and between suppliers. Reorders may not match an earlier order precisely. Where a supplier discontinues a garment or a color mid-order, we will contact you with the closest available substitute before proceeding.

Quantities

Industry-standard production tolerances apply. Where a run cannot be completed to the exact count due to garment defect or misprint, we will notify you and either adjust the invoice to the quantity delivered or complete the shortage in a follow-up run.

Production Time and Delivery

Production times quoted are estimates that begin after artwork approval and, where required, receipt of deposit or full payment — not from the date of the order. They do not include shipping transit time. Todd's is not liable for delays caused by suppliers, carriers, weather, or other circumstances outside our control. If you have a firm in-hands date, tell us in writing before ordering so we can confirm feasibility; rush charges may apply.

Payment

Payment terms are 50% deposit with balance due on delivery for new accounts; net 30 for approved accounts; payment in full before production for webstore orders. Purchase orders from schools, municipalities, and approved organizations are accepted subject to credit approval. Past-due balances may incur interest at 1.5% per month and may delay release of goods.

Cancellation

Orders may be cancelled before artwork approval at no charge other than art fees already incurred. Once garments are ordered, screens are burned, or decoration has begun, cancellation charges apply for materials, garments, and labor already committed. Orders cancelled after decoration is complete are billed in full.

Customer-Supplied Garments

We will decorate garments you provide, but we cannot guarantee results on goods we did not source, and we are not responsible for shrinkage, dye migration, fabric damage, or loss of customer-supplied items during decoration. Please supply spares.

Team and Corporate Webstores

Orders placed through our team and corporate webstores are additionally governed by our Webstore Terms, including store open and close dates, production schedules, and shipping methods. Where the two conflict, the Webstore Terms control for those orders.

Use of This Website

Content on this site, including images, text, logos, and designs, is the property of Todd's Sporting Goods or its suppliers and may not be reproduced without permission. You agree not to use this site for any unlawful purpose or to interfere with its operation.

Limitation of Liability

To the fullest extent permitted by law, Todd's total liability for any claim relating to an order is limited to the amount paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost events, or lost sales.

Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute will be brought in the state or federal courts located in Essex County, Massachusetts.
